1. Scope

This Privacy Policy explains how ProZpects collects, uses, discloses, and retains personal information when you use the Services, including athlete/parent profiles, video uploads, and messaging.

2. Minors; Parental Involvement

• The Services are intended for individuals who are at least thirteen (13) years of age.
• Users between thirteen (13) and eighteen (18) must use the Services with the involvement and consent of a parent or legal guardian.
• Parents/guardians may create, manage, and control minor accounts and are responsible for information submitted by or about the minor.
• Children under thirteen (13) may not use the Services without verifiable parental consent consistent with COPPA.
• We do not knowingly share personal information of users under sixteen (16) for cross-context behavioral advertising without legally required opt-in consent.

3. Personal Information We Collect

• Identifiers and contact information (name, email, phone, account IDs).
• Athlete profile data (sports, positions, metrics, recruiting preferences, accolades).
• Academic information voluntarily submitted (e.g., GPA, test scores, transcripts if uploaded).
• User-generated content (videos, photos, profile content, messages).
• Messaging metadata and content (for delivery, safety, compliance, and enforcement).
• Internet/network activity (cookies, IP address, device IDs; via Google Analytics and similar tools).
• Approximate location derived from IP address (not precise geolocation unless you provide it).
• Marketing/advertising engagement (campaign interactions, conversions).
• SMS interaction data (via Twilio and carriers).

4. Sources of Information

We collect information directly from you, automatically through your device and cookies, and from marketing/advertising partners and service providers.

5. How We Use Personal Information

• Provide, operate, and improve the Services.
• Create and display athlete profiles and recruiting materials.
• Facilitate lawful recruiting communication through messaging.
• Process subscriptions and payments.
• Send service notices, security alerts, and support messages.
• Send marketing messages and targeted advertising (where permitted), including via SMS where you opt in.
• Measure and improve performance and user experience (Google Analytics).
• Detect, prevent, and investigate fraud, abuse, safety incidents, and policy violations.
• Comply with legal obligations and enforce our Terms.

6. Cookies, Analytics, and Tracking

• We use cookies, pixels, SDKs, and similar technologies for essential functionality, analytics (including Google Analytics), and advertising/measurement.

• We may honor Global Privacy Control (GPC) signals where supported.

7. Targeted Advertising; Sharing; Partners

• We engage in targeted advertising and analytics. Under California law, certain practices may constitute “sharing” of personal information for cross-context behavioral advertising.

• We may share information with partners for advertising measurement and campaign delivery, subject to applicable law and your choices.

8. Disclosures of Personal Information

• Service providers (hosting, payment processors, customer support, Twilio for SMS, analytics providers like Google).
• Advertising and measurement partners (as configured) for targeted advertising and attribution.
• Legal and safety disclosures (to comply with law, respond to lawful requests, protect rights and safety).
• Business transfers (merger, acquisition, financing, or sale of assets).
• We do not sell personal information for monetary compensation; however, some targeted advertising may be “sharing” under CPRA.

9. State Privacy Rights

• California (CCPA/CPRA): You may have the right to know/access, delete, correct, obtain a portable copy, opt out of sale/sharing, limit use/disclosure of sensitive personal information (where applicable), and not be discriminated against for exercising rights.
• Other U.S. State Privacy Laws (as applicable): Residents of certain states (including, for example, Colorado, Connecticut, Virginia, and Utah) may have rights to access, delete, correct, obtain a copy of certain data, and opt out of targeted advertising and certain profiling. The availability of rights varies by state.
• How to exercise rights: Submit a request via https://www.prozpects.com/privacy-request, email privacy@prozpects.com, or phone 312-304-2816. We will verify your identity as required and respond within required timeframes. Authorized agents may submit requests where permitted by law.
• Global Privacy Control (GPC): Where supported, we treat GPC as a valid opt-out preference for sale/sharing and targeted advertising.

10. Sensitive Personal Information

We do not use or disclose sensitive personal information for purposes requiring a “Limit Use” opt-out under CPRA except as permitted by law.

11. Messaging Monitoring and Safety

• Messages and communications sent through the Services may be stored and, where appropriate, reviewed to enforce Terms, protect users (including minors), comply with law, and maintain platform integrity.
• We do not guarantee we will review any particular communication and we are not obligated to monitor.

12. FERPA Statement

• ProZpects is not a school and does not access official education records unless voluntarily uploaded by users.
• Users are responsible for ensuring that any academic information they share complies with FERPA or other applicable laws.

13. Data Retention

• Account data: retained during active use and up to 3 years after account closure (unless longer retention is required by law or for dispute/security).
• Messaging logs: retained up to 3 years for safety, compliance, and enforcement.
• Marketing data: retained until opt-out or 24 months of inactivity.
• Aggregated/de-identified data: may be retained indefinitely.

14. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is 100% secure.

We may update this Privacy Policy from time to time. We will post the updated version with a revised Effective Date. Continued use after changes means you accept the updated policy where permitted by law.
